SECTION 1:  HOW DOES ENVIROTRAK ANALYTICS LTD. USE YOUR PERSONAL INFORMATION?

When you complete a form on our website, create a user account or purchase services and/or products from our website, Envirotrak Analytics Ltd. collects the personal information that you give us, such as your name, address and email address.

When you use our website and user account website (Envirotrak IAQ platform, hereafter, "EnvirotrakIAQ"), we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about new services, products and other updates.

If you participate in promotions offered by Envirotrak Analytics Ltd. partners, that use a promo code, your address will be shared with the partner organization.

When using the services accessible through the EnvirotrakIAQ and software that has been downloaded to your desktop computer, smartphone or tablet to access services (Mobile App), the following are the limited situations where we may share personal information and/or data collected by your IAQ mult-sensor(s):

With your consent: We may share personal information when we have your consent. One example of this would be if you sign up for programs offered by our partners (e.g., insurance companies). If you do this, we may share certain information with our partner. This could include your enrollment information, the activation status of your IAQ device, and data, alerts, and/or notifications generated by the device. No mobile telephone information will be shared with third parties/affiliates for marketing/promotional purposes.

For external processing: We may work with vendors, service providers, and technicians who help with some of our data processing, analysis and data storage. They may also assist with monitoring our servers for technical problems. These technicians (as well as Envirotrak Analytics Ltd. employees) may be able to access certain information about you or your account in line with this work but will not be allowed to use this data for non-Envirotrak Analytics Ltd. purposes.

For business reasons: Upon the sale or transfer of the company and/or all or part of its assets, your personal information may be among the items sold or transferred. We will request a purchaser to treat our data under the privacy statement in place at the time of its collection.

We will own and may share non-personal customer information (for example, aggregated or anonymized customer data) publicly and with our partners. For example, we may publish trends about indoor air quality, moisture problems or frequency of issues in an office setting or in the home. This information may also be shared with other users to help them better understand their indoor air quality or moisture issues compared to others or raise awareness about health and safety issues. We may also share non-personal information with our partners, for example, if they are interested in providing demand-response services or other incentive programs.

Where and how long we keep personal information?

We generally hold personal information on secure servers located in Canada. Personal information may be held in the United States under the protection of the EU-US Privacy Shield. Where personal information is held in the United States, it may come under the application of U.S. law. We only keep personal information as long as the client account with us is active, unless we are required by law, for example, tax law, to keep it for longer.

SECTION 2: CONSENT

How do you get my consent?

When you provide us with personal information to complete a contact form, user account registration, verify your credit card or place an order, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to opt-out.

How do I withdraw my consent?

How we give access to personal information

Clients may request access to, ask to edit or remove their personal information that we collect and maintain by contacting us at account@envirotrak.ca. We will respond within 30 days. If we cannot provide access, for example because it would disclose personal information of a third person, we will provide justification.

SECTION 3: DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4: THIRD PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

Certain service providers may be located in or have facilities in a different jurisdiction. If you elect to proceed with a transaction on our website that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

For example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

By using this site, you represent that you are at least the age of majority in your province of residence, or that you are the age of majority in your province of residence and you have given us your consent to allow any of your minor dependents to use this site.
